Notice Concerning Proposed Kansas
Air Quality Construction Renewal

Notice is hereby given that the Kansas Department of Health and Environment (KDHE) is soliciting comments regarding a proposed air quality construction permit. Equilon Enterprises, LLC has applied for an air quality construction permit in accordance with the provisions of K.A.R. 28-19-300. Emissions of volatile organic compounds (VOC), particulate matter (PM), particulate matter with less than or equal to 10 microns in aerodynamic diameter (PM10), particulate matter with less than or equal to 2.5 microns in aerodynamic diameter (PM2.5), carbon monoxide (CO), oxides of nitrogen (NOX), oxides of sulfur (SOX), and hazardous air pollutants (HAPs) were evaluated during the permit review process.

Equilon Enterprises, LLC, 150 N. Dairy Ashford Rd., Houston, TX 77079, proposes to construct, own, and operate a Shell Downstream Galloway Biogas Processing Facility at High Plains Ponderosa Dairy located at 2042 V Rd., Plains, Meade County, KS 67869, at which a biogas processing facility is to be constructed.

A copy of the proposed permit, permit application, all supporting documentation, and all information relied upon during the permit application review process are available for public review from the date of publication during normal business hours at the KDHE, Bureau of Air (BOA), 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366 and at the Southwest District Office, 302 W. McArtor Rd., Dodge City, KS 67801. To obtain or review the proposed permit and supporting documentation, contact Shelley Schupp, 785-368-7030, at the central office of the KDHE or Ethel Even, 620-356-1075, at the Southwest District Office. The standard departmental cost will be assessed for any copies requested. The proposed permit, accompanied with supporting information, is available, free of charge, at the KDHE BOA Public Notice website, http://www.kdheks.gov/bar/publicnotice.html.

Please direct written comments or questions regarding the proposed permit to Shelley Schupp, KDHE, BOA, 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366. In order to be considered in formulating a final permit decision, written comments must be received no later than 12:00 p.m. Monday, April 5, 2021.

A person may request a public hearing be held on the proposed permit. The request for a public hearing shall be in writing and set forth the basis for the request. The written request must be submitted to Shelley Schupp, KDHE, BOA, 1000 SW Jackson, Suite 310, Topeka, KS 66612-1366, no later than 12:00 p.m. Monday, April 5, 2021in order for the Secretary of Health and Environment to consider the request.
